someone.ai is an AI-powered music generation platform that allows users to create personalised songs using Google's Lyria 3 technology. Songs are generated based on user-provided inputs including names, memories, occasion types, and musical preferences.

3. User accounts

You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account.

4. Content and intellectual property

When you create a song using someone.ai:

You retain the right to use, share, and gift the generated song for personal, non-commercial purposes.
Commercial use of generated songs requires a separate commercial licence agreement.
You must not use the Service to create content that is hateful, abusive, defamatory, or illegal.
You are responsible for ensuring that the personal information you provide about third parties has been obtained with appropriate consent.

5. Privacy and personal data

By using the Service, you consent to the collection and use of your data as described in our Privacy Policy. We process personal data including the names, memories, and relationship details you provide to generate your songs.

6. Payments and refunds

Payments are processed securely via Stripe. All prices are displayed inclusive of applicable taxes. Due to the nature of digital content generation, we do not offer refunds once a song generation has been completed and the audio file has been made available for download. If you experience a generation failure, please contact support for a credit or re-generation.

7. Free tier and limitations

Free tier users may preview generated songs within the app but may not download or share audio files without purchasing a paid plan. We reserve the right to modify free tier limitations at any time.

8. Prohibited uses

Generating songs that harass, defame, or target individuals without consent
Attempting to reverse-engineer or extract model weights or underlying systems
Using the Service to generate content that impersonates real individuals in a misleading way
Automated or bulk generation without prior written permission

9. Limitation of liability

The Service is provided "as is" without warranties of any kind. We do not guarantee that generated songs will meet your specific expectations or emotional needs. To the fullest extent permitted by law, someone.ai shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Changes to these terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify registered users of material changes via email.
